Changes to the Salary Threshold of the FLSA's White Collar Exemption on the Hori

The public comment period for the Department of Labor's proposal to increase the salary-level threshold for the white collar exemption under the Fair Labor Standards Act from $23,660 to $35,308 ended on May 21, 2019. If the proposed changes are adopted, employers will be required to evaluate their exempt employees to ensure they meet the increased salary requirement. For those falling below the proposed threshold, employers will have to either increase the employee's salary to meet the new threshold, or reclassify the employee to non-exempt and pay overtime premiums. The proposed rule is anticipated to take effect in January 2020.
